USTR Will Begin Accepting List 4A Exclusion Requests Effective October 31st

The office of the U.S. Trade Representative (USTR) announced plans to establish an exclusion process for products subject to additional Section 301 List 4A tariffs that went into effect on September 1st. Though no official announcement has been released yet, the USTR revealed that it will open an electronic portal for the submission of requested exclusions effective October 31st.
As is the case with preceding exclusions, List 4A exclusions will be effective for one year and will retroactively apply to all products meeting the specified criteria effective September 1, 2019 – the date the U.S. first imposed an additional 15% duties on List 4A Chinese products.
The USTR said that additional details associated with the exclusion application process for List 4A tariffs would be published in the Federal Register next week.
(As an aside, we have also heard that the USTR will issue another round of products excluded from 25% List 3 tariffs next week, which cover approximately 150 separate requests. Access the List 4A exclusion request portal, which will remain open for submission requests until January 31st, 2020.
