The office of the United States Trade Representative (USTR) officially published the List 2 exclusion process on Tuesday, September 18th.

Please take note of the following key points as they relate to the exclusion filing process:

  • The final list of Section 301 tariffs affected by list 2 can be found HERE
  • The final due date for exclusion submissions is December 18th, 2018
  • Exclusions can be submitted at www.regulations.gov under the “supporting documents” section using the docket number USTR-2018-0032
  • The USTR prefers electronic submissions
  • Comments can be adjusted and/or resubmitted up to 14 days after posting. Replies to comments are due within 1 week (7 days) of receipt
  • Any granted exclusion will be retroactive to August 23rd, the date of the imposition of these additional duties, and will be effective for roughly 1 calendar year
