On September 17, 2020, the Office of the U.S. Trade Representative (USTR) issued two sets of exclusion extensions for List 1 and 2 products that are currently set to expire on September 20.

The first notice granted extensions to 62 out of the 310 product exclusions from List 1. Click here to view the full list of List 1 products – including HTS codes and descriptions – that will retain their exclusionary status until December 31st.

The second notice granted extensions to 17 out of the 86 product exclusions from List 2. Click here to view the full list of List 2 products – including HTS codes and descriptions – that will retain their exclusionary status until December 31st.

The USTR failed to extend over 300 exclusions previously granted to products subject to List 1 and/or 2 tariffs. This means that the exclusionary status of these products will expire on September 20, 2020; effective September 21st, these products will carry the additional Chinese duties originally assessed.

In order to take advantage of the reduced duties, we encourage any importers of products that are retaining exclusionary privileges to schedule the products to arrive in the US prior to year’s end.  If you would like assistance with this, please reach out to [email protected].

As always, we encourage you to contact our compliance experts with any questions or for assistance with the exclusion process.

Shapiro will continue to monitor and provide status updates on our Section 301 Tariff News page as they become available.
