Per our Shap Flash posted on May 21st , the office of the U.S. Trade Representative (USTR) announced plans to establish an exclusion process for products subject to Section 301 List 3 tariffs. In an updated notice published today, June 20th, the USTR released official plans to open an electronic portal for the submission of requested exclusions effective June 30th, 2019 at 12 pm.
Granted List 3 exclusions will retroactively apply to all products meeting the specified criteria effective September 24th, 2018 – the date the U.S. first imposed an additional 10% duties on $200 billion of Chinese products.
Comments are due by September 30th, 2019 and can be adjusted and/or resubmitted up to 14 days after posting. Replies to comments are due within 1 week (7 days) of receipt.
